1. Is Buckeye Nation Rewards (BNR) affiliated with Ohio State?

Yes. Buckeye Nation Rewards (BNR) is a loyalty rewards program presented by The Ohio State University to provide university stakeholders with fun and rewarding ways to engage on digital platforms like websites, social media, email and mobile applications.

2. What is Buckeye Nation Rewards?

Buckeye Nation Rewards is the official loyalty and rewards program of The Ohio State University designed to make it fun and rewarding to engage with the University and its sponsors. By creating an account and participating in the program, you'll get personalized news, updates and offers that are available only to members of BNR. 

3. How do I join

Simply head to buckeyenationrewards.com and create and account from one of our options to get started. It's quick, easy and best of all, rewarding!

4. What can I win? 

We're constantly adding in new offers to the program. All you need to do is login and complete the various "Challenges" to earn GoBucks that unlock prizes or gain you chances to win great rewards. 

5. How does BNR work?

Users become members of BNR simply by signing up. Anyone can join the platform, and once you’re a member you receive points, called GoBucks, for interacting with content and completing challenges like sharing social posts, watching videos, taking surveys, or even checking in at locations with the BNR mobile application. GoBucks can be redeemed for prizes, and in some cases completing challenges will enroll members in chances to win sweepstakes and other rewards. 

6. Are GoBucks worth money?

No. GoBucks have no monetary value.

7. How does BNR use my information?

Information collected on BNR is used in different ways, mostly to create a more personalized experience for members on our platform by targeting relevant content and challenges that we think you will enjoy based on your preferences. 8. Where can I find all open sweepstakes BNR?

9. Do I have to buy anything to win a prize from BNR?

No. BNR never requires a purchase to win and making a purchase never improves your chances of winning.

10. Why is my state/province restricted from entry? 

Each state has its own rules governing sweepstakes, occasionally making it more difficult for a sponsor to offer a promotion in a particular state. Florida, New York and Rhode Island often are excluded because they have more restrictive laws governing prizes of high value. Although not legally restrictive, Alaska, Hawaii, the U.S. Virgin Islands and Canada are often omitted due to higher shipping costs for distributing prizes. Some other common restrictions include California, Tennessee and Utah for alcohol-related sweepstakes; Massachusetts, Michigan and Virginia for tobacco-related sweeps; while Quebec has particularly stringent laws about sweepstakes. 

11. Can those under 18 enter your sweepstakes? 

BNR is for people 18 and older. Because of COPPA and child protection rules, we cannot request personal information from anybody under the age of 18. 

12. How do I know if I am a winner? 

All winners are selected at random, and each potential winner will be contacted at the email address provided with their membership. Winners may also receive a package containing an Affidavit Of Eligibility and a Publicity Release. 

13. Where will I be able to see the list of winners of these sweepstakes? 

After each winner has been confirmed, that person's name, city and state/province will be posted on the "List of Winners" at BuckeyeNationRewards.com. 

14. If I win and accept the prize package, will I be responsible for paying all applicable taxes on the prize package? 

Yes. If the prize value is more than $600, the sponsor is required by law to report the prize (awarded to a U.S. resident) to the IRS. In which case the sponsor will request your social security number and send you an affidavit to fill out. If the prize value is less than $600 the sponsor is not required to report the prize and so may or may not choose to report it. In either case, it is your responsibility to include your accumulated winnings in your taxable income. 

15. If I win and accept the prize package, will I be responsible for delivery of the prize package? 

This depends on the sweepstakes. Check the official rules for more details. 

16. How do you choose your prizes? 

Prizes are offered by companies with whom we develop relationships, including sponsors and affiliates. If you have a prize you feel our visitors would be interested in, please email support@buckeyenationrewards.com.

17. What if I want to opt out of BNR?

You can opt out of BNR at any time. Simply visit the “My Account” section of the platform, and select the “opt out” option.

When you choose to opt out, BNR will retain all your user data for 30 days and then it will be permanently deleted.

You can reactivate your account at any point within 30 days by logging back in. Additionally, by opting out you will no longer receive updates or promotions from BNR and its sponsors.

Acceptance of the Terms of Use

We reserve the right, in our sole discretion without notice, to withdraw or amend this Platform, any service, material or content provided on the Platform, or any BNR Challenge (as defined below) or other activity. We will not be liable if for any reason all or any part of the foregoing is unavailable at any time or for any period. From time to time, we may restrict access to the Platform, in whole or in part.


Challenges

From time to time, BNR, its sponsors and/or vendors may present opportunities for eligible users to participate in sweepstakes and contests that award prizes (“Challenges”). In addition to these Terms of Use,  Challenges are subject to rules and conditions. including eligibility requirements, that can be found at http://buckeyenationrewards.com/.  Employees and immediate family members of employees of BNR sponsors, BNR vendors and the following departments and offices of The Ohio State University are not eligible to participate in Challenges: Procurement, Affinity & Trademark, Business & Finance, Board of Trustees, Office of President.  By participating in Challenges, you agree that you are eligible to do so and will abide by all such rules and conditions.

 

Intellectual Property Rights

The Platform and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by BNR, its sponsors, licensors or other providers of such content and materials and are protected by state and federal laws in the United States and other countries, including those governing copyrights, trademarks, patents, trade secrets, publicity rights and other intellectual property or proprietary rights.

For purposes of any information, software, text, displays, photos, images, drawings, video, audio or other content that you may post, deliver or otherwise make available to the Platform, directly or through social media channels (“User Supplied Content”), you hereby grant us a royalty-free, worldwide, perpetual right and license to store, use, reproduce, distribute, modify, create derivative works based on, publicly display and publicly perform such User Supplied Content and further represent that you have full right, power and authority to grant such license.

These Terms of Use permit you to use the Platform in order to interact with BNR and participate in Challenges. Except as expressly authorized, you may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit the Platform or its contents, in whole or in part, or delete or alter any copyright, trademark or other proprietary rights notices from this Platform or its contents provided that:

·       Your computer, tablet, smart phone or other similar device may temporarily store copies of such content in RAM incidental to your accessing and viewing that content.

·       You may store files that are automatically cached by your Web browser for display enhancement purposes.

  • If we provide desktop, mobile or other software applications for download, you may download a copy to your computer, tablet, smart phone or other similar device solely for your use, subject to these Terms of Use and provided that you agree to be bound by any other end user license agreement that may accompany such applications.

The name, “Buckeye Nation Rewards,” the terms, the BNR logo and all related names, logos, product and service names, designs and slogans are trademarks of BNR or its affiliates, sponsors or licensors. You may not reproduce or use such marks without the prior written permission of BNR or their respective owners. All other names, logos, product and service names, designs and slogans on this Platform are the trademarks of their respective owners.


Prohibited Uses

You may use the Platform only for lawful purposes and in accordance with these Terms of Use. You agree not to access or use the Platform:

·       In any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).

·       For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise.

·       To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter” or “spam” or any other similar solicitation.

·       To impersonate or attempt to impersonate BNR, a BNR employee, another user or any other person or entity (including, without limitation, by using e-mail addresses associated with any of the foregoing).

·       For any commercial purpose, without our express authorization.

·       To engage in any other conduct that restricts or inhibits any other party’s use or enjoyment of the Platform, or which, as determined solely by us, may harm BNR or users of the Platform or expose them to liability.

Additionally, you agree not to:

·       Use the Platform in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Platform, including their ability to engage in real time activities through the Platform.

Indemnification

You agree to defend, indemnify and hold harmless BNR and its affiliates, sponsors, licensors and service providers, and their respective employees, agents, officers, directors, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to any User Supplied Content or BNR’s use thereof, your violation of these Terms of Use or your use of the Platform, the Platform’s content, services, products or activities, including Challenges, or any information obtained from the Platform other than as expressly authorized in these Terms of Use.

 

Governing Law and Jurisdiction

All matters relating to the Platform and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Ohio without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Platform shall be instituted exclusively in the United States District Court or the courts of the State of Ohio in each case sitting in the City of Columbus and County of Franklin,  and you hereby submit to the personal jurisdiction of such courts and waive any and all objections to the exercise of such jurisdiction and to venue in such courts, provided that; we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your state or country of residence or in any other relevant jurisdiction.

 

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE PLATFORM MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

 

Waiver and Severability

No waiver of by BNR of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of BNR to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

 

Entire Agreement

These Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and BNR with respect to the Platform and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Platform.

 

Changes to the Terms of Use

We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Platform thereafter. However, any changes to the dispute resolution provisions set forth in Governing Law and Jurisdiction will not apply to any disputes for which the parties have actual notice on or prior to the date the change is posted on the Platform.

These are the official rules (“Official Rules”) of contests and sweepstakes presented on or through the Buckeye Nation Rewards (BNR) platform, including the website (at http://buckeyenationrewards.com/) and related Mobile App (collectively, the "BNR Platform" or “Platform”), by The Ohio State University, its BNR Platform vendors (collectively, "OSU," "we" or “us”) and sponsors (the “BNR Contests/Sweepstakes”).  

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN ANY BNR CONTESTS/SWEEPSTAKES AND MAKING A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  PARTICIPATION IN BNR CONTESTS/SWEEPSTAKES IS VOID WHERE PROHIBITED BY LAW.


1.    DESCRIPTION:  BNR Contests/Sweepstakes will have specified start dates/times and end dates/times (the "Promotion Period"). 

    The sponsors of each BNR Contest/Sweepstakes will be identified as such by name ("Sponsor").  By participating in the BNR Contests/Sweepstakes, each Participant unconditionally accepts and agrees to comply with and abide by these Official Rules, the additional rules applicable to each individual BNR Contest/Sweepstakes, if any (the “Additional Rules”) and the decisions of OSU and Sponsor, which shall be final and binding in all respects.  In the event of any conflict between these Official Rules and Additional Rules, such Additional Rules shall apply.  OSU and Sponsor are responsible for the collection, submission or processing of Entries and the overall administration of the BNR Contests/Sweepstakes.     The sponsors of each BNR Contest/Sweepstakes will be identified as such by name ("Sponsor").  By participating in the BNR Contests/Sweepstakes, each Participant unconditionally accepts and agrees to comply with and abide by these Official Rules, the additional rules applicable to each individual BNR Contest/Sweepstakes, if any (the “Additional Rules”) and the decisions of OSU and Sponsor, which shall be final and binding in all respects.  In the event of any conflict between these Official Rules and Additional Rules, such Additional Rules shall apply.  OSU and Sponsor are responsible for the collection, submission or processing of Entries and the overall administration of the BNR Contests/Sweepstakes. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, Youtube, Pinterest, LinkedIn, Apple or Google. You understand that you are providing your information to the owner of this sweepstakes and not to Facebook, Twitter, Youtube, Pinterest, LinkedIn, Apple, or Google.




2.   ELIGIBILITY:  Except as otherwise provided in any Additional Rules, BNR Contests/Sweepstakes are open to legal residents of the United States who are at least eighteen (18) years of age, are registered users of the BNR Platform and expressly agree to these Official Rules and all Additional Rules (“Participants”), provided that; officers, directors, employees and agents of Sponsor, The Ohio State University departments and BNR Platform vendors (the "Promotion Entities"), and Household Members and Immediate Family Members of each (“Excluded Users”) are not eligible to enter the BNR Contests/Sweepstakes or win a prize.  "Household Members" shall mean those people who share the same residence at least three months a year; "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses.  Each of the BNR Contests/Sweepstakes and eligibility for same is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law. 


3.  PRIZES:  Prizes will be identified separately for each of the individual BNR Contests/Sweepstakes


    Unless otherwise indicated in any Additional Rules, only one prize per person and per household will be awarded.  Gift cards and gift certificates that may be awarded as prizes are subject to the terms and conditions of the respective issuers.  Prizes cannot be transferred, redeemed for cash or substituted by winner.  BNR Contests/Sweepstakes Sponsors reserve the right, in their sole and absolute discretion, to award substitute prizes of equal or greater value if a prize identified in a particular BNR Contest/Sweepstakes is unavailable or cannot be awarded, in whole or in part, for any reason.  The value of any prize represents Sponsor's good faith determination, which is final and binding and cannot be appealed.  Sponsors make no representation or warranty concerning the appearance, safety or performance of any prize awarded.  Restrictions, conditions, and limitations may apply.  Sponsors will not replace any lost or stolen prize items.
    
    Except as otherwise provided in any Additional Rules, prizes will only be awarded and/or delivered to addresses within the United States.  All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner.  Failure to comply with the Official Rules will result in forfeiture of the prize.


4.  HOW TO ENTER:  Except as otherwise provided in any Additional Rules, Participants may enter each BNR Contest/Sweepstakes during the applicable Promotion Period by engaging with content on the BNR Platform, which can be found at buckeyenationrewards.com, or via the BNR mobile application.

    Except as otherwise provided in any Additional Rules, each Entry must be made by the Participant and automated or robotic Entries submitted by individuals or organizations will be disqualified.  Any attempt by a Participant to make, obtain or secure more than the permitted number of Entries in any individual BNR Contest/Sweepstakes by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void such Participant's Entries and that Participant may be disqualified from that and future BNR Contests/Sweepstakes.  All Entries must be posted by the end of the Promotion Period in order to be considered, and OSU or its designated representative will be the official timekeeper for their respective BNR Contests/Sweepstakes.


    Except as otherwise provided in any Additional Rules, all Entries and information therein submitted in connection with the each BNR Contest/Sweepstakes (collectively, "Entry Materials"), together with all copyright, trademark and other proprietary rights associated therewith, will become the property of OSU upon submission.

5.  WINNER SELECTION:  Except as otherwise provided in any Additional Rules, the winner(s) of each BNR Contests/Sweepstakes will be determined as follows:

(i)              In the case of sweepstakes, the winner(s) will be selected by random drawing from among all eligible Entries received throughout the Promotion Period, which random drawing will be conducted after the Promotion Period by OSU or its designated representative, whose decision(s) in selecting/identifying the winner(s) are final.  The odds of winning such sweepstakes will vary depending on the number of eligible Entries received.
(ii)           In the case of contests, the winner(s) will be selected according to the criteria set forth in the Additional Rules for each such contest, as determined by OSU or its designated representative, in their sole and complete discretion, whose decision(s) in selecting/identifying the winner(s) are final. 

 

In all instances, final eligibility for the award and receipt of any prize is subject to eligibility verification as set forth below.

 


6.  WINNER NOTIFICATION/CONFIRMATION:  Except as otherwise provided in any Additional Rules, each winning Participant will be notified by email at the email address provided in that Participant’s Entry within approximately five (5) business days of the selection of the winner(s) as described above.  Except as otherwise provided in any Additional Rules, each potential prize winner must confirm eligibility and acceptance of her/his prize by email, as directed by OSU or its designated representative. within 5-10 business days of notification.  Neither OSU or its designated representative is responsible for any delay in or failure to receive notification from any potential prize winner for any reason, including inactive email account(s), technical difficulties associated therewith, or any potential prize winner’s failure to adequately monitor any email account.

    Any notification of winning to which no response is received or which is returned as undeliverable may result in forfeiture of the prize.  The potential prize winner may be required to execute and return an affidavit of eligibility, release of liability and/or a publicity release (collectively, "Prize Claim Documents").  No substitution or transfer of a prize is permitted except by OSU or its designated representative.


7.  PRIVACY:  Except as otherwise provided in any Additional Rules, any personally identifiable information (“PII”) supplied by Participants will be subject to the BNR Privacy Policy posted at http://buckeyenationrewards.com/.  By entering any BNR Contests/Sweepstakes, each Participant grants the OSU, its designated representative, and its BNR Platform vendors permission to share Participant’s email address and other PII with third parties engaged for purposes of BNR Contests/Sweepstakes administration and prize fulfillment, and to use same in publicly available lists of BNR Contests/Sweepstakes winners, which may be posted on the BNR Platform and otherwise disseminated by or through OSU and Sponsors.


8.  RESULTS: To request a winners list for a BNR Contest/Sweepstakes, Participants may send a self-addressed, stamped envelope to: 2400 Olentangy River Road, Suite E146, Columbus, OH 43215.  Such requests must be received within three (3) weeks of the end of the Promotion Period for the BNR Contest/Sweepstakes.

 

 

9.  SOCIAL MEDIA DISCLAIMER:   Participants may register on or access the BNR Platform or prepare or submit an Entry for a BNR Contest/Sweepstakes using a social media account (e.g., a Facebook account).  BNR Contests/Sweepstakes are in no way sponsored, endorsed or administered by, or associated with any such social media platform, nor is any such media platform in any way sponsored, endorsed or administered by, or associated with OSU or any Sponsor.  Participants who choose to participate in any BNR Contest/Sweepstakes via such a social media platform may also be subject to such social media platform’s privacy policy, terms of use and the like.


10.  RELEASE & LIMITATIONS OF LIABILITY:  By participating in a BNR Contest/Sweepstakes, each Participant agrees to release and hold harmless OSU and Sponsor and each of their affiliates, subsidiaries, officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the BNR Contests/Sweepstakes or receipt or use of any prize therefrom, including, but not limited to: (a) any error that may prevent an entrant from submitting an entry; (b) unauthorized intervention in the BNR Contests/Sweepstakes; (c) printing or typographical errors in materials associated with the BNR Contests/Sweepstakes; (d) lost or late Entries; (e) errors in the administration of the BNR Contests/Sweepstakes or the processing of Entries; (f) alleged or actual violations of rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional; (g) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; or (h) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the BNR Contests/Sweepstakes or receipt of any prize, whether under a theory of contract, tort (including negligence), warranty or otherwise.  

 

Participant acknowledges and agrees that OSU and Sponsors assume no responsibility or liability for (a) any incomplete, incorrect or inaccurate information in any Entry form or Entry, or for any faulty or failed transmission(s) of same; (b) any unauthorized access to, or theft, destruction or alteration of any Entry form or Entry or any information therein; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the BNR Platform or any BNR Contests/Sweepstakes; (d) any inaccessibility or unavailability of the BNR Platform or any network or wireless service, the Internet, any wireless or landline telephone service, any website or any combination thereof; or (e) any harm or damage to Participant's or any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the BNR Contests/Sweepstakes or to access or download any materials related to any BNR Contests/Sweepstakes.

Participant further agrees that in any cause of action, the Released Parties’ liability will be limited to the out-of-pocket cost to Participant of entering and participating in the BNR Contests/Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

IF PARTICIPANT IS A CALIFORNIA RESIDENT, PARTICIPANT WAIVES CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR” (OR ANY EQUIVALENT STATUTORY PROVISION WITH A SIMILAR IMPORT OR INTENT). IF PARTICIPANT IS A RESIDENT OF A STATE OTHER THAN CALIFORNIA, PARTICIPANT EXPLICITLY WAIVES THE TERMS AND PROTECTIONS OF ANY STATUTE OF HIS/HER STATE THAT HAS A SIMILAR IMPORT OR INTENT.

 


11.  CANCELLATION, TERMINATION, SUSPENSION:  If, for any reason, any BNR Contest/Sweepstakes is not capable of running or operating as planned, for reasons which may include, without limitation, infection by malware or computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of any BNR Contest/Sweepstakes, OSU and Sponsor reserve the right, at their sole discretion, to cancel, terminate, modify or suspend such BNR Contest/Sweepstakes, in whole or in part.  In such event, OSU and Sponsor shall immediately suspend all drawings, selections and prize awards, provided further that; in such event, OSU and Sponsor reserve the right to award any remaining prizes in a manner deemed fair and equitable by OSU and Sponsor, in their sole discretion.  Sponsor and Released Parties shall not have any further liability to any participant in connection with the BNR Contests/Sweepstakes.

 

 

12.  SEVERABILITY:  These Official Rules are severable, and if any portion is determined to be invalid or unenforceable by a body of competent jurisdiction, the remaining portions will remain valid, enforceable and in effect to the fullest extent consistent with applicable law.

 

 

13.  GOVERNING LAW, DISPUTES:   The BNR Contest/Sweepstakes, including these Official Rules and any Additional Rules, shall be governed under the laws of the State of Ohio, without regard to conflicts of law principles to the contrary.

[Except where prohibited, any controversy, claim or dispute arising out of any BNR Contest/Sweepstakes, including these Official Rules and any Additional Rules (and further including, without limitation, arising from any Participant’s dealings with Sponsors for products and/or services promoted in, awarded in, linked or otherwise associated with such BNR Contest/Sweepstakes) (collectively, “Claims”) shall be resolved by final and binding arbitration to be conducted in Columbus, Ohio and administered by a single arbitrator pursuant to American Arbitration Association Commercial Arbitration Rules. In order to keep costs down for all parties, arbitration hearings may, at the request of Sponsor or OSU, be conducted telephonically or entirely upon written submissions.]   

OR

Any controversy, claim or dispute arising out of any BNR Contest/Sweepstakes, including these Official Rules and any Additional Rules (and further including, without limitation, arising from any Participant’s dealings with Sponsors for products and/or services promoted in, awarded in, linked or otherwise associated with such BNR Contest/Sweepstakes) (collectively, “Claims”) shall be adjudicated in the state and federal courts located in Franklin County, Ohio and Participants expressly consent to the exercise of jurisdiction of such courts and waive any objection based upon venue therein.  In addition to the above, Participants waive any right to bring any Claim as a class action, consolidated, multi-district or collective action, or private attorney general action and agree not to participate in any such proceeding regarding any Claim. 

If OSU or Sponsor prevails in any [arbitration OR legal proceeding] against a Participant hereunder, it shall be entitled to recover, in addition to all other available legal and equitable relief, its legal costs, including attorneys’ fees.

This privacy policy (the "Privacy Policy") describes practices regarding the collection, use and dissemination of information by, on or through the Buckeye Nation Rewards platform, including this website (at http://buckeyenationrewards.com/) and related Mobile App (collectively, the "BNR Platform" or “Platform”), as presented by Ohio State and its designated representatives.  This Privacy Policy supplements the Terms of Use (see http://buckeyenationrewards.com/) governing access to and use of the BNR Platform by users like you (“User” or “You”).  Capitalized terms used but not defined in this Privacy Policy have the same meanings as in the Terms of Use. 

We may modify this Privacy Policy from time to time. If we make changes to this Privacy Policy, we will post those changes at this location and may otherwise provide notice of any material changes so that You are aware of what information we collect, how we use it, and under what circumstances, if any, we share or disseminate it. Please review this Privacy Policy on a periodic basis.

 

Age Limit 

Please be advised that the BNR Platform is intended for use only by Users who are at least 18 years of age. Users under the age of 18 must gain parental consent before participating. We do not knowingly solicit or accept PII from minors or send them requests for information.


Information We Collect 

The BNR Platform is primarily informational in nature and most of it is publicly available (i.e., to all Users).  Unless and until You choose to register with the BNR Platform or participate in surveys, Challenges or other Platform offerings, You may browse the Platform without providing any of Your personally identifiable information (which means information that can be linked to You as a particular individual, such as Your name, address, phone number, email address and the like -- collectively, “PII”), although Your browser may tell us what type of computer and operating system You are using, as well as other kinds of technical information.

If You do choose to engage with the BNR Platform, you acknowledge and agree that we may collect or receive various types of PII.  The types of PII collected will vary depending upon how You use the BNR Platform. 

Most information is gathered during the registration processes that the BNR Platform utilizes to allow access to and/or use of certain information and features of the Platform. However, PII may be collected at other times, as well, including, for example, when Users complete survey forms, respond to requests for information or content, complete Challenges, request communications or report a problem with the Platform. Specific examples of types of PII the BNR Platform may collect include:

 

Contact Information, such as a User’s name, address, phone number, facsimile number, and email address. 

Demographic Information, such as certain characteristics common to a segment of the population and profile data provided voluntarily by Users in response to surveys, sponsorship offerings, advertisements for products, and/or collected in order to continue to improve the quality of the BNR Platform and its services.

Survey Results, such as the answers and submissions Users provide in response to surveys, questionnaires and other inquiries sent to or made of Users from, on or through the BNR Platform.

Technical Information, such as Internet Protocol (IP) addresses from collected from Users of the Platform, as well as the date and time of access and the Web page(s) accessed. The BNR Platform may catalog Users’ log-in information and computer, browser, and/or operating system information and maintain a database of aggregated information about certain transactions on the Platform (e.g., tool or feature utilization or recipe selection data).

Special Categories of PII, which reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership; genetic or biometric data uniquely identifying a  natural person; and data concerning a person’s health, sex life or sexual orientation (“Special Categories of PII”) will only be collected and processed with Users’ explicit consent for specified purposes.

  

How We Use Such Information

Different types of information collected or received on or through the BNR Platform, including PII, is used in different ways, including the following.

Contact Information. We may use Your contact information collected on or through the BNR Platform for many purposes, including, to advertise its services and the goods and services of third parties, to create a personalized experience for You, to provide You with news and information, to contact You regarding surveys, to notify You of material changes in the BNR Platform's policies, to advise You of new services the BNR Platform may offer, to share testimonials or otherwise. We may also share Your contact information with our affiliates and business partners, in order to provide services and information, for advertising purposes, and for internal business purposes.  We do not share your individual contact information with other third parties for any other purpose, except as required by law (for example, to a court or government agency) or in the case that sharing arrangements are established with Platform affiliates, vendors or business partners, those parties will be identified in an addendum to the Privacy Policy below. 

Demographic Information. We may share certain demographic data collected on or through the BNR Platform with our Affiliates, but only on an aggregated basis, which will not identify any particular User.

Survey Results. We may share survey results collected on or through the the BNR Platform with our Affiliates and/or the general public, the news media, and state or federal government agencies, not only for business or marketing purposes or as may be required by law, but also to participate in government programs and initiatives. 

Technical Information. We may use technical information to help diagnose problems with our the BNR Platform and its servers, to analyze the Platform's usage trends, track User movements on the Platform, and to otherwise manage and monitor the Platform.

 

More generally, we may disclose information collected on, by or through the BNR Platform, including PII, when legally required to do so in accordance with government requests or regulations or legal proceedings. We may also disclose such information, including PII, to protect against misuse or unauthorized use of the Platform or as is otherwise required to limit legal liability, to protect or defend our rights, property, or interests, or to protect the safety, rights, or property of others, including Users.

Similarly, in the event that there is a business transaction, such as a merger or acquisition by another company involving the transfer of all or a portion of the BNR Platform’s assets, please note that the information collected on, by or through and retained by the BNR Platform, including PII, may be among the assets transferred. In such an event, we will notify You via email and/or place a prominent notice on the Platform at least 30 days before any such change in ownership or control of the Platform and Your PII, and the possible changes to this Privacy Policy that could result.

Special Categories of PII,  Note that notwithstanding anything to the contrary herein, we will only process or use Special Categories of PII for the specified purposes for which Users’ explicit consent was given.

  

Cookies

Cookies are bits of text that may be stored on Users’ computers by their Web browsers for record-keeping purposes, such as to capture preferences.  Cookies enable the BNR Platform to customize and enhance Your experience while using the Platform. Cookies may also enhance Web-surfing by automatically performing certain functions and by ensuring that You do not see the same advertisement repeatedly. Because many consider the use of cookies to be an industry standard, Your Web browser is likely set to accept cookies. If You would prefer not to receive cookies, however, You can alter the configuration of Your browser to refuse or delete cookies. If You choose to have your browser refuse or delete cookies, please understand that some areas of the Platform may not function fully or properly when You view them.


Links to Social Media Pages & Other Websites

You should be aware that social media pages or third-party websites that may be accessed from the BNR Platform through hyperlinks or gateways (like banner advertisements) may themselves collect PII, are not controlled by the BNR Platform and are not subject to this Privacy Policy. Most such websites or social media pages have their own privacy policies and we suggest that you check those in order to understand how the proprietors of social media pages or third party sites may use your PII.

  

Security

The BNR Platform employs industry standard security measures to protect against the loss, misuse, and alteration of information under the Platform's control. Although we have undertaken to create a secure and reliable Platform, You should understand that the confidentiality of any communication or material or information provided to or through the Platform cannot be guaranteed. Accordingly, You should consider carefully whether to submit sensitive information to the BNR Platform. We urge you to take every appropriate precaution to protect your PII when on-line.

 

Consenting or "Opting Out" of Data Collection & Use

As explained above, You are permitted to browse the Platform without registering.  Similarly, You can also decide whether to provide various types of information, including PII, to the Platform when requested, or “opt out” of doing so (i.e., decline to provide it). For example, if the BNR Platform conducts a survey, You do not have participate unless You agree to do so. If You should choose to opt out, Your user data will be retained for 30 days and then it will be permanently deleted. You can reactivate your account at any point within 30 days by logging back in. Additionally, by opting out You will no longer receive updates or promotions from Buckeye Nation Rewards or its sponsors and affiliates.  If our collection or use of certain PII relies on Your consent, we will try to ask for such consent clearly and plainly and You may choose to give such consent or not, or give it and then later change Your mind and withdraw it.  (See “Requesting, Updating, Deleting Information & Withdrawing Consent,” below.)  The BNR Platform also provides You with the opportunity to opt out of certain Platform business practices or activities where Your PII may be used. For example, Users may opt out of having the Platform use their PII in order to include them in mailings (hard copy) or email communications or newsletters sent by the Platform.  

  

Requesting, Updating, Deleting Information & Withdrawing Consent

The BNR Platform will retain Your PII for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws. You may contact the BNR Platform at any time (including by the means described under “Questions,” below) to request a copy of, review, update, correct or delete information that You provided to  the Platform or withdraw any consent related thereto that You previously gave. You should, of course, be aware that the collection and uses of certain information , including PII, is necessary in order to provide certain information and services through the Platform, and the deletion of such information (such as an email address) may preclude a particular service or the Platform's ability to provide same to You.

By registering for Buckeye Nation Rewards or completing specific challenges within Buckeye Nation Rewards, you will qualify to submit entries into “The Roosters 2018 Buckeye Bowl Game Giveaway”. Each week, for a period of twelve (12) weeks (the “Giveaway Period”), Roosters will select, by conducting a random drawing among all eligible entries received by Roosters, Ten (10) Weekly Prize Winners; and One (1) Grand Prize Winner. During the Giveaway Period, Roosters will give away a total of One Hundred and Twenty (120) Weekly Prizes; and Twelve (12) Grand Prizes. All winners will be contacted via email (if provided by entrant on the Entry Form) or by telephone. For promotional purposes, all winners will also be announced on social media. In no event shall any entrant who has been selected as a Grand Prize Winner for the Roosters 2018 Buckeye Bowl Trip be selected as a Grand Prize Winner for a different week during the Giveaway Period for the Roosters 2018 Buckeye Bowl Trip Giveaway.

When you complete an action in Buckeye Nation Rewards that qualifies for an entry to “The Roosters 2018 Buckeye Bowl Game Giveaway,” Buckeye Nation Rewards will share the following personal information with Roosters Restaurants: First Name, Last Name, Email Address, Age, and Phone Number (Phone Number only if you are selected as a winner to allow Roosters Restaurants to contact you and you have added it into your profile). This information will be used to verify your entries and may also be used by Roosters Restaurants to send you promotional material or special offers.
